These Terms of Service ("Terms") govern your access and use of Humma.AI's website, mobile applications, and other products and services (collectively, the "Humma.AI Platform" or "Platform"). 1. Eligibility 

 

The Humma.AI Platform is intended for users who are at least 18 years of age. By using the Platform, you represent and warrant that you are at least 18 years old. If you are under 18, you may not access or use the Platform.

 

2. User Accounts

 

To access certain features of the Humma.AI Platform, you may be required to create a user account. When creating an account, you agree to provide accurate, current, and complete information about yourself. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

 

3. User Content

 

The Humma.AI Platform allows users to share personal stories, experiences, and other content ("User Content"). You retain ownership of any User Content you submit, post, or display on or through the Platform. However, by providing User Content, you grant Humma.AI a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such User Content on the Platform and in connection with Humma.AI's business activities, including the development of our Empathetic AI™ model.

 

4. Empathetic AI Membership

 

Humma.AI offers an "Empathetic AI" membership program through which users can voluntarily participate in training and developing our Empathetic AI™ model. Participation in the Empathetic AI program requires your explicit consent, which you can provide through a clear and accessible opt-in process on the Platform. You have the right to withdraw your consent and discontinue your Empathetic AI membership at any time.

 

5. Prohibited Conduct

 

You agree not to use the Humma.AI Platform for any unlawful or prohibited purpose. This includes, but is not limited to, engaging in hate speech, harassment, or the dissemination of illegal or harmful content. Humma.AI reserves the right to remove or restrict access to any User Content or account that violates these Terms.

 

6. Intellectual Property

 

The Humma.AI Platform and its entire contents, features, and functionality are owned by Humma.AI and protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

 

7. Termination

 

Humma.AI reserves the right to suspend or terminate your access to the Platform at any time for any reason, including if we reasonably believe that you have violated these Terms. You may also delete your Humma.AI account at any time.

 

8. Disclaimers and Limitation of Liability

 

The Humma.AI Platform is provided "as is" and without warranties. Humma.AI shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Platform.

 

9. Governing Law and Dispute Resolution

 

These Terms shall be governed by and construed in accordance with the laws of the State of California, without giving effect to any choice or conflict of law provision. Any disputes arising out of or related to these Terms or the Humma.AI Platform shall be resolved through binding arbitration.

 

10. Changes to Terms

 

Humma.AI may update these Terms from time to time. We will notify you of any material changes by posting them on the Platform or through other means of communication.
